I think your decision to allow them to make it right is reasonable and the good thing to do. However, I would recommend that you get it checked over completely by another shop after they complete the work. Remember, when you make demands that require money, they are placed in a difficult position in that they do not have it and then things become legal, and then only the attorneys profit and you are left with little. You are make the best decision with the situation you have at hand. The luxury of doing what you want is just not there and I support your decision to give them one last chance.

If they fuck up after this, then go ballistic and seek damages out of every orifice of their business. While you might get a judgment for negligence, getting an award for fraud will have a higher legal standard meaning you will have to convince a jury by clear and convincing evidence, a difficult standard.

The more I read this thread the more I think you are making a mistake. Wouldn't you feel better running this whole scenario past a good lawyer detailing this whole process BEFORE
you leave your Jeep at this shop? If he/she agrees with your decision so be it, but wouldn't showing up at this shop with a lawyer present to document the expectations and requirements
you are both agreeing to be a safer bet? You spent $30K man! That's serious dough. If this doesn't work then you're still screwed. Think they will be willing to do anything further past this
next attempt at an engine swap?

That is a good point, out here in the court of public opinion. I am not a lawyer and I am not familiar with Florida laws. However, prior to admitting that evidence, you would need an expert who can state to a reasonable degree of mechanical certainty that the failures depicted in the video were as a direct result of the faulty work of the shop. There is a chance that the video would never be shown in the court. And besides, the cost of an expert like that could run as high as $15,000 or more.

I have had many instances when our expert was excluded through a motion in limine here in Nevada, very frustrating. Again, I am not saying this would be the case in Florida, but still, there are always risk in litigation, for both sides. These are things that the OP has to consider.

Yeah, I am not at all familiar with the FL laws, but I was asked to be an expert witness in a civil hearing (wait a minute - I didn't get shit for doing that!) here in PA and it was in front of a 3 judge panel. My prep was done 5 minutes before I had to take the oath and I wasn't wearing any Depends. But I digress....in my case my word was taken at face value. I don't know how it would work down there in Florida. All the more reason to get the lawyer involved NOW!!!

The question I would ask myself is whether I would ever trust anything they built me to get me home off the trail.

I absolutely echo this question...when you are 30, 50, 80 miles into deep back country, this will be in the back of your mind the whole trip..."will my rig crap out on me on the trail...again?"

And on top of that, when asked point blank why you're switching to an LS, you don't say anything about your treatment at Bruiser. I guess I wouldn't either since they're taking your Jeep back for more work, but just sucks for the next guy who gets your pos engine.
